These Terms of Use ("Terms") govern your use of DALE 4 - AI Art Generator ("DALE", "the app"), operated by Ali Kaptanoğlu. By downloading or using the app, you agree to these Terms. If you do not agree, please do not use the app.
1. The service
DALE lets you generate, edit, remix, and design images and logos from text prompts using artificial intelligence, create slideshow videos, and store your creations locally on your device. Features and availability may change over time.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use DALE. By using the app you confirm that you meet this requirement.
3. Credits, subscriptions & billing
- DALE offers a limited number of free daily credits and a Premium subscription that unlocks additional features and generations.
- Subscriptions are billed through your Apple App Store account. The exact price and any free‑trial terms are shown in the app before you confirm your purchase, in your local currency.
- Auto‑renewal: your subscription automatically renews at the end of each billing period unless auto‑renew is turned off at least 24 hours before the period ends. Your account is charged for renewal within 24 hours before the end of the current period.
- Managing & cancelling: you can manage or cancel your subscription anytime in your device's App Store account settings. Cancellation takes effect at the end of the current billing period.
- Payments are non‑refundable except where required by law or by Apple's applicable policies. Refund requests are handled by Apple.
4. Acceptable use
You agree not to use DALE to create, upload, or share content that:
- is illegal, hateful, harassing, violent, or sexually explicit, or that exploits or endangers minors;
- infringes the intellectual property, privacy, or other rights of any person;
- impersonates a real person or misleads others, including deceptive deepfakes;
- attempts to bypass the app's content filters, security, or usage limits, or to reverse‑engineer the service.
DALE applies automated filtering to block prohibited prompts, but you remain responsible for how you use the content you create.
5. Your content & ownership
You are responsible for the prompts you enter and the images you generate. Subject to your compliance with these Terms and applicable law, you may use the images you create with DALE, including for personal and commercial purposes. You are responsible for ensuring your use of generated content does not violate any third‑party rights or local laws.
6. Intellectual property
The DALE app, its name, design, and software are owned by the developer and protected by law. These Terms do not grant you any right to our trademarks, logos, or source code.
7. AI‑generated results
Images are produced by artificial intelligence and may be unexpected, inaccurate, or similar to other outputs. DALE does not guarantee that any generated image is unique, error‑free, or suitable for a particular purpose.
8. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non‑infringement. We do not warrant that the service will be uninterrupted, secure, or error‑free.
9. Limitation of liability
To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, or consequential damages, or loss of data or profits, arising from your use of or inability to use DALE.
10. Termination
We may suspend or terminate access to the app if you violate these Terms. You may stop using the app at any time by uninstalling it.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.
